ABSTRACT

Many still consider adherence to rules as defining legal defensibility. However, these people have either not had any experience in the trying of a case or have assumed that acceptance by the attorney means defensibility. This talk provides an attack of sorts on this assumption of defensibility by following rules through examples of where failures to follow rules still led to successful prosecution, where even following the rules can lead to trouble, and when someone might successfully defend against prosecution. The presenter will rely on many years of investigative work, experiences as a witness, and research to provide a picture that should have most questioning their sense to security may lead some to wonder if they are safe from attack.
